SUNFISH LAKE PLANNING COMMISSIONMEETING – APRIL 17, 2019

7:00 P.M. – ST. ANNE’S EPISCOPAL CHURCH

1. CALL TO ORDER: Chair Hendrickson called the meeting to order at 7:00 p.m.

2. ADOPT AGENDA: Chair Hendrickson asked if there were any additions to the agenda and there was no response.

Commissioner Beckett moved to adopt the agenda, seconded by Commission Nayes and carried (5-0)

3. APPROVE MINUTES MARCH 20, 2019 AND FEBRUARY 20, 2019: Chair Hendrickson asked if there were any additions or corrections to the March 20 or February 20, 2019 Minutes.

Clerk Iago explained that the February 20, 2019 minutes that were approved at the March meeting were not the correct version and that they had now been corrected to include language that was originally omitted as noted by Commissioner Driano.

Commissioner Nayes moved to approve the minutes from the March 20, 2019 meeting as presented, seconded by Commissioner Nelson and carried. (5-0)

Commissioner Driano moved to approve the February 20, 2019 as corrected, seconded by Commissioner Nayes and carried. (5-0)

4. PUBLIC HEARING: A. Major Site and Building Plan Review and Conditional Use Permit, 2150 Charlton Road: Commissioner Hendrickson opened the public hearing for the purpose of reviewing the Major Site and Building Plan Review and Conditional Use Permit for property located at 2150 Charlton Road. He explained that the applicant had asked that this matter be tabled to the May meeting. He explained that the Commission had held the site visit and that they would not do so prior to the May meeting. He further explained that the applicant plans to have the site staked for the home location next Monday and that, if the property owner agrees, the Commissioners are welcome to drive to the property to view the site after the stakes are in place.

Peter Eskuche, Architect for the project, stated that the property owner would allow the Commissioners to view the site after the stakes are in place.

Chair Hendrickson asked the Planner would provide a brief overview of the project and then the Commission would receive public comments.

Planner Grittman explained that the applicant submitted plans for a Major Site and Building Plan Review and a Conditional Use Permit for a new home and an oversized attached garage at 2150 Charlton Road. He stated the property owner intends to tear down the existing home and construct a new home that would be located in approximately the same place as the existing home, but slightly back from the lake. He stated that the application appears to meet all setback and other requirements and that Conditional Use Permit if necessary since the garage exceeds the maximum allowed of 1,250 sq. ft.; he noted the garage would accommodate an indoor sports court.

The Planner advised that the application would be tabled to the May meeting due to the fact that the plans need to be revised to move the home four (4) feet to the west on the property. He stated that the Commission would review the revised plan at their May meeting and take action at that time.
Chair Hendrickson asked if there were any comments from the audience.

Peter Eskuche, Architect for the project, commented that he was told the matter would be tabled due to the need for a modified storm water plan.

Chair Hendrickson explained that anytime a plan is not complete or needs modification, the Commission delays action until the plan is complete. He advised that if all issues had not been addressed by the City Engineer or items need to be completed, the application cannot be sent forward to Council until it is a completedpackage.

Planner Grittman further advised that it was too late to cancel the meeting this evening since the public hearing was placed in the newspaper and poste at the Church.

Chair Hendrickson asked if there were any comments from the Commission and, hearing none, opened the hearing for comments from the public.

Robert Riesberg, 343 Salem Church Road, stated that he is pleased the proposal meets the setback requirements. He advised that he lives across the lake and that he hopes the plan does not remove numerous trees from the site. He noted there is a stand of trees that are over 100 years old and asked if those trees would remain on the property.


Mr. Eskuche stated the applicant requested that all trees remain on the property, however, some of the trees must be taken down to accommodate building the home. He explained that all the trees along the shoreline would be saved and one large tree near the existing home would be removed to accommodate the new construction.


Steve Ettinger, 2158 Charlton Road, noted that the property is heavily wooded and asked how many Oak trees are on the property.

Mr. Eskuche stated that there are too many to count.

Chair Hendrickson asked if there were any further comments from the audience and there was no response. He then asked if there were any comments from the Commissioners and there was no response. He advised that the Commission should take action to continue this matter to the May meeting.

Commissioner Nayes moved to continue the Public Hearing and table action on the application on this matter to the May 15, 2019 Planning Commission meeting, seconded by Commissioner Driano and carried. (5-0)


OTHER/NEW BUSINESS: Chair Hendrickson asked if there was any new business or comments from the public.

Molly Park, 15 Sunnyside Lane, commented that the last few months a number of homes had been purchased, torn down and planned to be re-built. She noted this is wonderful for the community, but asked if there are engineering standards for storm water management when a tear down and rebuild occurs.

Planner Grittman explained that he is not an engineer and noted that Sunfish Lake lots were not platted the same as other residential developments that had calculated and defined areas for storm water drainage. He pointed out that each lot in Sunfish Lake is basically its own development and that the regulations specify that the new home construction cannot increase the amount of storm water runoff, therefore, it must be the same as the existing home. He further advised that there are options for controlling the storm water runoff on the property such as installing underground cisterns, or ponds or rain gardens.

Chair Hendrickson noted that there are regulations that require the applicant obtain a permit for soil excavation that exceeds 50 cubic yards. He explained that the permit must be submitted to the City Engineer for approval and to require options for installing protection to insure the soils remain on the property and do not enter the lakes.

Ms.Park asked if the City has any stipulations to preserve the history of the properties or to require recycling of the materials from the existing home tear down.

Chair Hendrickson commented that in his experience as a contractor, most homeowners wish to recycle materials if possible and most contractors also recycle as much material as possible versus placing them in landfills.

Ms.Park commented that as a citizen she would support historical preservation and questioned if the City had any desire to designate older homes for historical preservation. She noted that the Barrett home at 2150 Charlton was considered the “crown jewel” of the community when it was constructed. She offered her assistance to such a project if the City so desired to pursue such a project.

Commissioner Nayes thanked Molly for her ideas and offered to discuss them with the newly formed “Welcome Committee”.

She invited Molly to attend the committee meetings to further discuss this matter.

Chair Hendrickson asked if there were any further comments or business items for discussion and there was no response.

ADJOURN: Commissioner Driano moved to adjourn the meeting at 7:18 p.m., seconded by Commissioner Nelson and carried. (5-0)
