SUNFISH LAKE PLANNING COMMISSION SPECIAL MEETING – JUNE 5, 2018
6:00 P.M. – ST. ANNE’S EPISCOPAL CHURCH

1. CALL TO ORDER: Chair Hendrickson called the meeting to order at 7:00 p.m.
2. ADOPT AGENDA: Chair Hendrickson asked if there were any additions to the agenda. He asked that an item be added: Discussion of the Mayor’s Resignation. He asked if there were any further additions and there was no response.
Commissioner Hansen moved to adopt the agenda as amended, seconded by Commissioner Beckett and carried (4-0)
3. APPROVE MINUTES MAY 16, 2018: Chair Hendrickson asked if the minutes should be approved this evening or be tabled until the next regular Commission meeting.
After a brief discussion, the Commissioners agreed to delay approval of the minutes until the next regular Planning Commission meeting when all Commissioners are present.
Chair Hendrickson moved to table approval of the May 16, 2018 Planning Commission meeting minutes to the next regularly scheduled Planning meeting, seconded by Commissioner Hansen and carried. (4-0)
4. PUBLIC HEARING: A. MAJOR SITE AND BUILDING PLAN REVIEW AND TWO (2) VARIANCES, 2570 Delaware Avenue, Jeremy Segal: Chair Hendrickson opened the meeting for the purpose of the continued Public Hearing relating to the Major Site and Building Plan and Variance application for the property located at 2570 Delaware Avenue. He explained the Planner would give a brief review the application and then he would open the Public Hearing for comments from the audience. He asked that anyone wishing to speak provide their name and address, or their relationship to the applicant.
Planner Grittman explained the request for approval of a Major Site and Building Plan Review and two (2) variances to allow construction of an addition to the existing home located at 2570 Delaware Avenue was reviewed at the May 16 meeting. However, due to the fact that the notice of the hearing was not published in time to meet requirements for conducting a public hearing, the Commission scheduled this Special Meeting in order to take formal action on this matter prior to Council review.
The Planner explained that he would not review the Major Site and Building Plan portion of the application since the application meets all R-1 Single Family requirements as listed in the Zoning Ordinance. He noted that the City Clerk advised him that the Commission did not discuss the two (2) variances requested in the application at the last meeting, therefore he would discuss the variances.
Planner Grittman advised that the proposed addition would be located on the southern portion of the property entirely within the shoreland setback of 200 ft. After reviewing the proposal, staff determined this to be the best location for the addition as it would have the least negative impact on the existing well. He explained that the proposed addition would also encroach on the side yard setback on the south side of the property.
The Planner stated that staff recommends approval of the two (2) variance requests based on the practical difficulties resulting from unique topographic and lot configuration conditions on the parcel. He noted that the proposed location takes advantage of existing level areas and reduces the need for additional excavation, fill or grading on the site and the fact that it would not be realistic to remove and relocate the existing well.
Chair Hendrickson asked if there were any questions from the Commissioners.
Commissioner Spaulding asked the Planner the proposed setback distance from the side yard.
Planner Grittman stated the proposed side yard setback would be 21.2 ft. and the standard setback is 50 ft. He commented that locating the addition on any other area of the lot would still require a variance.
Chair Hendrickson asked if there were any further questions from the Commission and, hearing none, opened the public hearing for comments from the audience.
Jeremy Segal, 2570 Delaware, thanked staff and the Commission for scheduling this special meeting to expedite the application and for their assistance throughout the process.
Chair Hendrickson asked if there were any further comments from the audience and, hearing no response, closed the public hearing. He asked if there were any further comments or questions from the Commission and there was no response.
Chair Hendrickson moved to recommend to Council approval of the Major Site and Building Plan and the two (2) variance requests for the Shoreland and Side Yard Setbacks for property located at 2570 Delaware Avenue as presented based on the findings of fact and subject to the eight (8) conditions as outlined in the Planner’s Report dated May 9, 2018, seconded by Commissioner Spaulding and carried. (4-0)
The Planner pointed out that the applicant brought the roof material for the Commission to review since it is not listed as an approved material in the Zoning Code.
Chair Hendrickson explained that the applicant should present the roofing material at the Council meeting since they would have the authority to approve the material.
MISCELLANEOUS: Chair Hendrickson stated that current Sunfish Lake Mayor would be moving out of the City and would resign his position in the next few month. He explained that this had occurred with other elected officials in the past and that Council normally asks if there is anyone on the Planning Commission that wished to be appointed to fill any unexpired terms on Council. He asked if there were any Commissioners who would not wish to serve as a member of the Council.
Commissioner Spaulding stated he would not be interested in serving as a member of Council at this time.
Chair Hendrickson asked if there was any further discussion and there was no response.
ADJOURN: Commissioner Beckett moved to adjourn the meeting at 6:15 p.m., seconded by Commissioner Hansen and carried. (4-0)
