SUNFISH LAKE PLANNING COMMISSION MEETING

Commissioner Dominick Driano was absent.


1.    CALL TO ORDER:  Chair Hendrickson called the meeting to order at 7:00 p.m.

2.    ADOPT AGENDA:  Chair Hendrickson asked if there were any additions to the agenda and there was no response.

Commissioner Beckett moved to adopt the agenda as presented, seconded by Chair Hendrickson.  Motion carried (4-0) 

  1. APPROVE MINUTES, OCTOBER 20, 2022, PLANNING COMMISSION MEETING: Chair Hendrickson asked if there were any additions or corrections to the October 20, 2023, Planning Commission meeting minutes.


Commissioner Nayes moved to approve the October 20, 2022, Planning Commission minutes seconded by Commissioner Hendrickson.  Motion carried. (4-0)

Note:  Commissioner Nayes stepped down from the dais for this presentation and vote on the application for 32-55th Street West as property owner.

  1. PUBLIC HEARING: A. MAJOR SITE AND BUILDING PLAN REVIEW, 32-55th Street West, applicant Jim and Jeannine Nayes: Chair Hendrickson opened the meeting for the purpose of a public hearing on the application for a Major Site and Building Plan Review for the property located at 32-55th Street West.  He reviewed the procedures for conducting a public hearing and asked the Planner to present her report.

Planner Johnson referred to her report dated March 16, 2022, as well as the presentation packet that was distributed this evening.  The property is zoned Rural Residential and is located in the R-1, Shoreland Overlay.   She advised that the homeowners have submitted an application for a Major Site and Building Plan Review approval.  The applicants are Jim and Jeannine Nayes, the acreage of the site is 3.55 and the existing land use is Rural Residential and is located in the R-1, Shoreland Overlay District.

The Planner stated the new home will be 4,408 square feet, have two (2) exterior decks which consist of a cement pad for a hot tub (west) and at the exit from the main level to the ground at the rear of the home.  The property exceeds the setback requirements and the impervious surface of 4.9% meets requirements.  The building coverage is 2% and also meets the requirements.  The existing driveway access on 55th Street West will remain.

As shown on the presentation the house will be Verseta steel siding, Ascend siding and the stone will be removed from the plans submitted.  The height of the house will be 26.75 and does meet the height requirements.

The Planner went over the landscaping and tree removal/preservation.  There will be only one significant tree removed and it will be replaced with one White Pine. The new home will also have a solar array.  All lighting will be on the building with one pole mounted (existing) light near the driveway which meets the City requirements.  The DNR area hydrologist confirmed there are no comments on this project.

The Planner stated that staff recommends approval of the Major Site and Building Plan Review subject to the Findings of Fact and with the eleven (11) conditions as listed in the Planner’s report both documents dated March 16, 2023.

Chair Hendrickson asked if there were any further comments from the applicant or property owner and there was no response.  He asked if there were any further comments from the public at this time.  Dave Carpenter, member of First Calvary Church and neighbor wanted to confirm their support of the plans.

Chair Hendrickson asked if the Commissioners had any questions or comments.  Commissioner Beckett asked about the existing foundation and asked if that was being removed.  Jeannine Nayes stated that the big mound of dirt where the house is going to go, the stone foundation is still there and that will be removed.  Commissioner Beckett mentioned that the Planner’s Report did have an error in the narrative.

Commissioner Wu mentioned about the issues with the road that is being taken care of by the City and is owned by the State and to be aware there could be potential fixes in the future and to make sure the timelines are not going to be interrupting with the build.  Commission Wu also asked about the driveway and lighting due to the activities in the cul-de-sac.

Chair Hendrickson asked if there were any further questions or comments and, hearing none, closed the public hearing.

Chair Hendrickson moved to approve the Major Site and Building Review for property located at 32-55th Street West, Jim and Jeannine Nayes property owners, based on the Findings of Fact dated March 16, 2023, and subject to the eleven (11) conditions listed in the Planner’s report dated March 16, 2023.

 Seconded by Commissioner Beckett and Motion carried. (3 - 1 abstain Nayes)

 Commissioner Nayes rejoined the meeting.

OTHER/NEW BUSINESS: 

  1. PLANNING COMMISSION SCHEDULE:

Chair Hendrickson moved to adopt Resolution No. 23-01, Setting the Dates of the Regular Planning Commission Meetings for the Year 2023, seconded by Commissioner Nayes.  Motion carried (4-0)

 Chair Hendrickson asked if there were any further comments or questions.  City Planner noted that in the future the site visits will start at 6:30 p.m. unless differently noted on the agenda.  The City Planner indicated that there will not be a meeting in April but she has received items for the May meeting.

Chair Hendrickson moved to adjourn the meeting at 7:35 p.m., seconded by Commissioner Nayes.  Motion carried. (4-0)
